5. DEPOSIT AND PAYMENT DEADLINES

A deposit of at least 50% of the agreed total price, including taxes, is required before Deep Blue Co., Ltd can confirm your booking. The minimum 50% deposit applies to all booked services, including third-party services.

The balance deadline is stated in your booking confirmation. Depending on the yacht and agreed arrangements, payment is due 30, 14 or 7 days before departure, or at boarding before the cruise starts. Any expressly agreed yacht-specific deadline takes priority. A booking made after its applicable balance deadline requires payment in full before confirmation.

Where payment of the balance at boarding has been agreed, please pay in cash in Thai Baht. Payment in a foreign currency requires prior agreement. Choosing cash does not automatically defer an earlier agreed balance deadline.

Payment authorisation or signing a Charter Agreement does not itself process a payment or mark an invoice as paid. Your payment account/card holder status and any authorisation to pay for another guest must be stated accurately.

6. PAYMENT PROCESSING FEES

When paying by credit card, PayPal or other electronic payment methods, a payment processing fee is charged to cover costs imposed by third-party payment providers. The service amount, processing fee and total payable are shown separately before payment.

Deep Blue Co., Ltd retains disclosed processing fees that have actually been incurred and cannot be recovered from the provider, including when Deep Blue Co., Ltd cancels because of weather or technical reasons, only to the extent permitted by applicable law and payment-provider rules.

Customers who wish to avoid Deep Blue Co., Ltd payment processing fees may pay by bank transfer or Wise, or in cash in Thai Baht at our office or upon boarding (balance only). Bank transfer and Wise are offered without an additional Deep Blue Co., Ltd processing fee, where available. The customer’s bank or transfer provider may charge its own fees.

Payment processing fees, including credit card, PayPal and bank transfer surcharges, are separate from charter and third-party service cancellation charges. Refunds following a website error or a proposed price adjustment under section 13 include payment processing fees, as expressly stated in that section.

7. CANCELLATION BY THE CUSTOMER — CHARTER

7.1 Binding booking. Only the deposit makes the booking binding. Therefore, if the customer unilaterally terminates the contract (cancels the booking), a refund of the deposit is not possible in all cases. Customer cancellation charges reflect the lead time and the difficulty of replacing the booking. Please send cancellation requests in writing to the same WhatsApp contact through which your charter was booked. In an emergency, use the official contact email address published on the website: info@yacht-tours-thailand.com. The notice period runs from receipt of the cancellation to the scheduled departure time; one day means 24 hours and times are interpreted in Thailand time (UTC+7).

7.2 Calculation. The percentages below are cancellation FEES calculated on the full booked charter price including taxes, excluding separately priced third-party services and payment processing fees. Payments already made towards the charter are credited against the cancellation fee. Any excess is refunded. If payments are insufficient to cover the fee, the unpaid part of that fee remains due; no additional original charter balance is due beyond that fee. A 0% fee means a full refund of charter payments received. A 100% fee means no charter refund and the full charter price remains due. Processing fees are handled separately under section 6.

7.3 Applicable category. The yacht’s main boat-type category, shown in the booking confirmation, determines the applicable row. Secondary categories or marketing descriptions such as Luxury or Superior do not change it. Overnight/multi-day means the actual booked charter includes an overnight stay, not merely that the yacht is capable of overnight use.

Private Speedboat / Luxury Speedboat — All

  • 30 days or more: 0%
  • 3 to less than 30 days: 25%
  • Less than 3 days: 100%

Motor Yacht / Sailing Monohull / Power Catamaran / Sailing Catamaran — Day charter

  • 90 days or more: 0%
  • 30 to less than 90 days: 25%
  • Less than 30 days: 100%

Motor Yacht / Sailing Monohull / Power Catamaran / Sailing Catamaran — Overnight / multi-day

  • 90 days or more: 0%
  • 30 to less than 90 days: 50%
  • Less than 30 days: 100%

Large Group Boat / Superyacht — All

  • 90 days or more: 25%
  • Less than 90 days: 100%

7.4 No-show. If the customer does not attend the charter, the cancellation fee is 100% of the full charter price for every category. Amounts already paid are credited and any unpaid balance remains due. An operator cancellation is not a customer no-show.

7.5 Special conditions. Expressly agreed yacht-specific conditions may override the conflicting points of this schedule under section 1. The accepted conditions apply to the booking; later changes do not apply retrospectively.

8. CANCELLATION BY THE CUSTOMER — THIRD-PARTY SERVICES

Separately booked third-party services include, for example, taxis, catering, DJs and decoration. The minimum 50% deposit applies to these services too. Some services require 100% payment in advance and are non-refundable in the event of customer cancellation or no-show. These conditions will be stated before booking.

Unless the service was booked on the 100% non-refundable basis described above, if the customer cancels a booked third-party service or does not attend, the cancellation fee is 50% of the full booked third-party service price, including taxes, regardless of the notice period or yacht category. Exception: a taxi transfer cancelled because the customer is not ready is a no-show charged at 100% of the transfer price under section 2.

For services subject to the standard 50% cancellation fee, payments already made towards that service are credited against the fee. A standard 50% deposit is therefore retained in full. If more than 50% has been paid, the excess is refunded. Any original unpaid service balance beyond the cancellation fee is waived. The fee is 50% of the service price, not 50% of the deposit.

Third-party services are calculated separately from the charter cancellation fee. The same item is not also deducted from the charter refund. Payment processing fees are handled separately under section 6.

This customer-cancellation rule does not determine refunds when Deep Blue Co., Ltd cancels; see section 9. The full-refund provisions in section 13 take precedence where cancellation follows a website error or a proposed price adjustment.

9. CANCELLATION BY Deep Blue Co., Ltd AND FORCE MAJEURE

If the booked tour cannot safely be completed because of a technical problem or dangerous weather conditions predicted by the Marine Department Thailand, Deep Blue Co., Ltd will offer an alternative date or a full refund of the charter price paid. Payment processing fees are handled under section 6.

As an alternative to a monetary refund, the customer may choose a credit voucher for the full charter amount including the payment processing fee, valid for 12 months from the original booking date. The voucher may be used for any charter operated by Deep Blue Co., Ltd.

Where force majeure prevents Deep Blue Co., Ltd from performing its obligations, amounts paid for the unperformed services will be refunded, subject to the Payment Processing Fees section and the third-party service cancellation rule below. No additional compensation is payable solely because of that force majeure, except where mandatory law requires it.

If Deep Blue Co., Ltd cancels the charter, 50% of the full booked price of third-party services is retained as a cancellation fee. Payments already made towards those services are credited against the fee; any amount paid above 50% is refunded and any original unpaid balance beyond that fee is waived. This also applies where cancellation is due to force majeure. The full-refund provisions for website errors and proposed price adjustments in section 13 take precedence.

10. TRAVEL CANCELLATION INSURANCE

Extraordinary events such as personal illness, a pandemic, closure of borders or airports, war or riots may make cancellation unavoidable. Where the charter remains available and the customer cancels, the customer cancellation provisions apply, subject to mandatory law. Where Deep Blue Co., Ltd itself cannot perform, the cancellation-by-Deep-Blue provisions apply.

We recommend taking out travel cancellation insurance. Alternatively, check whether third-party services are covered by any cancellation insurance already included in your flight ticket. Deep Blue Co., Ltd provides official invoices for insurance claims. Acceptance and reimbursement depend on the insurer and policy; Deep Blue Co., Ltd cannot guarantee them. To date, our customers have not reported any issues with insurers accepting our invoices.
