Terms and Conditions

1. GENERAL AND CONTRACT DOCUMENTS

Deep Blue Co., Ltd, TAT licence number 34/03030, offers and arranges boat tours in Thailand through yacht-tours-thailand.com, either directly or in cooperation with other operators. Registered address: 61/23 Moo 6, Ratsada Muang, Phuket 83000, Thailand. Booking and cancellation contact: info@yacht-tours-thailand.com or the same WhatsApp contact through which your charter was booked.

These Terms apply to the boat rental or tour you book. Your booking confirmation and Charter Agreement identify the yacht type and size, trip, date, departure time and place, duration, guests, included services, separately booked services, prices, payment schedule and applicable cancellation category.

Yacht-specific special conditions disclosed and expressly agreed before booking take priority only on points that conflict with these general Terms. All remaining general provisions continue to apply. A later website amendment does not change an existing agreement. The accepted Terms, special conditions and booking details are retained as a fixed record.

2. CHARTER SERVICES AND CUSTOMER DELAYS

The charter, including meals and additional services, must be paid in full before the cruise starts, subject to the earlier payment deadline agreed for your booking. Accepted methods include cash, bank transfer and credit card; available electronic methods and any permitted processing fee are disclosed before payment.

Boat rentals include fuel, a licensed captain and crew, safety equipment, first-aid equipment and insurance covering accidents on the boat only. They also include all services stated as included for the booked offer on the website or agreed in writing during booking. Only written agreements are binding. Additional complimentary services may be provided, but the agreed services will not be reduced except as permitted by these Terms or agreed with you.

Voluntary non-use of an offered service, expectations beyond the agreed services, customer-caused delays or termination due to the customer’s rule-breaking conduct do not create a refund entitlement for the affected services. This does not remove remedies for services that Deep Blue Co., Ltd failed to provide as agreed.

Waiting time counts as charter time. If you arrive late without a prior agreement, the lost time is non-refundable. An extension beyond the agreed end time requires a further agreement and may incur an additional charge. Please keep in mind that most boats cannot cruise after sunset. If your late arrival reduces the available tour time, the captain may adjust the planned itinerary to account for the delay.

An arranged taxi will usually wait a maximum of 15 minutes. If the transfer must be cancelled because the customer is not ready, this is treated as a no-show and 100% of the transfer price remains payable. Payments already made are credited against that amount. The customer must arrange alternative transport.

The boat may not be sublet to a third party.

3. OPERATION, SAFETY AND CONDUCT

Deep Blue Co., Ltd may change routes and pickup or drop-off locations where weather conditions or other legitimate operational or safety reasons require it. The captain is responsible for the vessel and has final authority over operational and safety decisions. Safety takes priority.

The captain may interrupt or end the voyage immediately if misconduct endangers safety or causes property damage. Persons whose alcohol or drug impairment makes participation unsafe may be refused boarding. The captain must exercise these powers in accordance with Thai law. In such cases, the customer’s payment obligations remain.

Passengers must follow crew instructions immediately, including instructions to wear life jackets. Outside areas controlled by the Marine Department, wearing the supplied life jackets is also recommended at all times; any stricter applicable safety requirement or captain’s instruction takes priority.

Crew may refuse access to vessels and jetties when reasonably necessary for capacity, safety, public order, or an imminent risk of damage or nuisance.

Passengers must protect the environment, must not dispose of waste in the water, and must place food and drink waste and other rubbish in the appropriate bins on board.

4. RESPONSIBILITY, INSURANCE AND LIABILITY

Deep Blue Co., Ltd is not liable for damage and/or loss of passenger property. Passengers take all their belongings on board at their own risk.

All tours booked with Deep Blue Co., Ltd include insurance for accidents on the boat only.

Apart from this insurance, Deep Blue Co., Ltd is not liable for personal injury or property damage of any kind, regardless of cause, before, during or as a result of the trip. This does not apply to damage caused by intent or gross negligence on the part of Deep Blue Co., Ltd. To the extent permitted by law, compensation is limited to the charter price for the respective trip.

Deep Blue Co., Ltd shall not be liable for any damage to persons or property of passengers caused by stepping onto or boarding a jetty or boat. Passengers enter these areas entirely at their own risk.

Guests are responsible for damage they cause through their fault to property used by Deep Blue Co., Ltd or third parties, subject to applicable law.

All shore and water activities organised by Deep Blue Co., Ltd take place at your own risk.

Children are the responsibility of their parents. Children under the age of four are required to sit on their parents’ laps.

5. DEPOSIT AND PAYMENT DEADLINES

A deposit of at least 50% of the agreed total price, including taxes, is required before Deep Blue Co., Ltd can confirm your booking. The minimum 50% deposit applies to all booked services, including third-party services.

The balance deadline is stated in your booking confirmation. Depending on the yacht and agreed arrangements, payment is due 30, 14 or 7 days before departure, or at boarding before the cruise starts. Any expressly agreed yacht-specific deadline takes priority. A booking made after its applicable balance deadline requires payment in full before confirmation.

Where payment of the balance at boarding has been agreed, please pay in cash in Thai Baht. Payment in a foreign currency requires prior agreement. Choosing cash does not automatically defer an earlier agreed balance deadline.

Payment authorisation or signing a Charter Agreement does not itself process a payment or mark an invoice as paid. Your payment account/card holder status and any authorisation to pay for another guest must be stated accurately.

6. PAYMENT PROCESSING FEES

When paying by credit card, PayPal or other electronic payment methods, a payment processing fee is charged to cover costs imposed by third-party payment providers. The service amount, processing fee and total payable are shown separately before payment.

Deep Blue Co., Ltd retains disclosed processing fees that have actually been incurred and cannot be recovered from the provider, including when Deep Blue Co., Ltd cancels because of weather or technical reasons, only to the extent permitted by applicable law and payment-provider rules.

Customers who wish to avoid Deep Blue Co., Ltd payment processing fees may pay by bank transfer or Wise, or in cash in Thai Baht at our office or upon boarding (balance only). Bank transfer and Wise are offered without an additional Deep Blue Co., Ltd processing fee, where available. The customer’s bank or transfer provider may charge its own fees.

Payment processing fees, including credit card, PayPal and bank transfer surcharges, are separate from charter and third-party service cancellation charges. Refunds following a website error or a proposed price adjustment under section 13 include payment processing fees, as expressly stated in that section.

7. CANCELLATION BY THE CUSTOMER — CHARTER

7.1 Binding booking. Only the deposit makes the booking binding. Therefore, if the customer unilaterally terminates the contract (cancels the booking), a refund of the deposit is not possible in all cases. Customer cancellation charges reflect the lead time and the difficulty of replacing the booking. Please send cancellation requests in writing to the same WhatsApp contact through which your charter was booked. In an emergency, use the official contact email address published on the website: info@yacht-tours-thailand.com. The notice period runs from receipt of the cancellation to the scheduled departure time; one day means 24 hours and times are interpreted in Thailand time (UTC+7).

7.2 Calculation. The percentages below are cancellation FEES calculated on the full booked charter price including taxes, excluding separately priced third-party services and payment processing fees. Payments already made towards the charter are credited against the cancellation fee. Any excess is refunded. If payments are insufficient to cover the fee, the unpaid part of that fee remains due; no additional original charter balance is due beyond that fee. A 0% fee means a full refund of charter payments received. A 100% fee means no charter refund and the full charter price remains due. Processing fees are handled separately under section 6.

7.3 Applicable category. The yacht’s main boat-type category, shown in the booking confirmation, determines the applicable row. Secondary categories or marketing descriptions such as Luxury or Superior do not change it. Overnight/multi-day means the actual booked charter includes an overnight stay, not merely that the yacht is capable of overnight use.

Private Speedboat / Luxury Speedboat — All

  • 30 days or more: 0%
  • 3 to less than 30 days: 25%
  • Less than 3 days: 100%

Motor Yacht / Sailing Monohull / Power Catamaran / Sailing Catamaran — Day charter

  • 90 days or more: 0%
  • 30 to less than 90 days: 25%
  • Less than 30 days: 100%

Motor Yacht / Sailing Monohull / Power Catamaran / Sailing Catamaran — Overnight / multi-day

  • 90 days or more: 0%
  • 30 to less than 90 days: 50%
  • Less than 30 days: 100%

Large Group Boat / Superyacht — All

  • 90 days or more: 25%
  • Less than 90 days: 100%

7.4 No-show. If the customer does not attend the charter, the cancellation fee is 100% of the full charter price for every category. Amounts already paid are credited and any unpaid balance remains due. An operator cancellation is not a customer no-show.

7.5 Special conditions. Expressly agreed yacht-specific conditions may override the conflicting points of this schedule under section 1. The accepted conditions apply to the booking; later changes do not apply retrospectively.

8. CANCELLATION BY THE CUSTOMER — THIRD-PARTY SERVICES

Separately booked third-party services include, for example, taxis, catering, DJs and decoration. The minimum 50% deposit applies to these services too. Some services require 100% payment in advance and are non-refundable in the event of customer cancellation or no-show. These conditions will be stated before booking.

Unless the service was booked on the 100% non-refundable basis described above, if the customer cancels a booked third-party service or does not attend, the cancellation fee is 50% of the full booked third-party service price, including taxes, regardless of the notice period or yacht category. Exception: a taxi transfer cancelled because the customer is not ready is a no-show charged at 100% of the transfer price under section 2.

For services subject to the standard 50% cancellation fee, payments already made towards that service are credited against the fee. A standard 50% deposit is therefore retained in full. If more than 50% has been paid, the excess is refunded. Any original unpaid service balance beyond the cancellation fee is waived. The fee is 50% of the service price, not 50% of the deposit.

Third-party services are calculated separately from the charter cancellation fee. The same item is not also deducted from the charter refund. Payment processing fees are handled separately under section 6.

This customer-cancellation rule does not determine refunds when Deep Blue Co., Ltd cancels; see section 9. The full-refund provisions in section 13 take precedence where cancellation follows a website error or a proposed price adjustment.

9. CANCELLATION BY Deep Blue Co., Ltd AND FORCE MAJEURE

If the booked tour cannot safely be completed because of a technical problem or dangerous weather conditions predicted by the Marine Department Thailand, Deep Blue Co., Ltd will offer an alternative date or a full refund of the charter price paid. Payment processing fees are handled under section 6.

As an alternative to a monetary refund, the customer may choose a credit voucher for the full charter amount including the payment processing fee, valid for 12 months from the original booking date. The voucher may be used for any charter operated by Deep Blue Co., Ltd.

Where force majeure prevents Deep Blue Co., Ltd from performing its obligations, amounts paid for the unperformed services will be refunded, subject to the Payment Processing Fees section and the third-party service cancellation rule below. No additional compensation is payable solely because of that force majeure, except where mandatory law requires it.

If Deep Blue Co., Ltd cancels the charter, 50% of the full booked price of third-party services is retained as a cancellation fee. Payments already made towards those services are credited against the fee; any amount paid above 50% is refunded and any original unpaid balance beyond that fee is waived. This also applies where cancellation is due to force majeure. The full-refund provisions for website errors and proposed price adjustments in section 13 take precedence.

10. TRAVEL CANCELLATION INSURANCE

Extraordinary events such as personal illness, a pandemic, closure of borders or airports, war or riots may make cancellation unavoidable. Where the charter remains available and the customer cancels, the customer cancellation provisions apply, subject to mandatory law. Where Deep Blue Co., Ltd itself cannot perform, the cancellation-by-Deep-Blue provisions apply.

We recommend taking out travel cancellation insurance. Alternatively, check whether third-party services are covered by any cancellation insurance already included in your flight ticket. Deep Blue Co., Ltd provides official invoices for insurance claims. Acceptance and reimbursement depend on the insurer and policy; Deep Blue Co., Ltd cannot guarantee them. To date, our customers have not reported any issues with insurers accepting our invoices.

11. PAYMENT AUTHORISATION, COMPLAINTS AND DISPUTES

The payer must either be the payment account/card holder or identify the holder and confirm that the holder has authorised the payment. If the payer will not join the charter, the nominated travelling guest must be identified. Payment authorisation and the travelling guest’s boarding confirmation are separate declarations.

Please report any problem promptly to the crew or booking team so that it can be investigated and, where possible, addressed. Boarding or signing a boarding record does not waive a genuine complaint or a legal remedy for a defect.

Customers and payers must provide truthful information in any payment dispute. In particular, they must not knowingly claim that an authorised payment was unauthorised or that a charter did not take place when the booked service was provided to them or their nominated guest.

A payment reversal does not by itself decide whether a contractual debt exists. Deep Blue Co., Ltd may submit relevant booking, payment, communication and service evidence and pursue any debt that remains legally due. There will be no double recovery. A dispute outcome alone does not establish dishonesty.

Deep Blue Co., Ltd may seek documented, directly caused and legally recoverable costs of a knowingly false claim, only to the extent permitted by applicable law and provider rules. No automatic penalty or fixed chargeback fee is imposed by these Terms. Nothing here excludes legitimate chargeback, statutory refund or payment-provider dispute rights.

12. ELECTRONIC RECORDS AND PERSONAL DATA

The Charter Agreement may be signed electronically. Our booking system stores the accepted Terms and booking details, signature, recorded confirmations and relevant transaction references. A separate boarding record may include a photograph taken at boarding and the guest’s signature. A payment confirmation given before the charter is not a statement that boarding has already occurred.

Confirmation and boarding evidence is retained for 12 months after the charter. Relevant records may be retained longer where a dispute remains unresolved or a legal retention obligation applies. Accounting records may have a separate legal retention period.

Relevant evidence may be shared where necessary and lawful with the operator, payment provider, bank, insurer, advisers or competent authorities. See https://yacht-tours-thailand.com/privacy-policy for information on how personal data is processed and how to exercise your data rights. Privacy contact: info@yacht-tours-thailand.com.

13. WEBSITE ERRORS, PRICE ADJUSTMENTS, GOVERNING LAW AND JURISDICTION

Deep Blue Co., Ltd may correct errors in website descriptions and prices. Before a booking becomes binding, any correction will be communicated before the customer proceeds. If a material error is discovered after the booking becomes binding, Deep Blue Co., Ltd will explain the error and propose a correction. No correction to the agreed price or services takes effect without the customer’s express agreement. If the customer declines the proposed correction, Deep Blue Co., Ltd will honour the original agreement or offer cancellation with a full refund of all amounts paid to Deep Blue Co., Ltd for the booking, including payment processing fees and booked third-party services, without cancellation charges. Such corrections do not exclude liability that cannot lawfully be excluded.

For bookings made more than 180 days before the scheduled departure, Deep Blue Co., Ltd may propose a price adjustment to reflect documented increases after booking in fuel prices, statutory taxes or port charges directly affecting that charter. Any adjustment must be limited to the actual additional cost attributable to the booking and must not exceed 10% of the originally agreed charter price in total. Deep Blue Co., Ltd will provide a written explanation and calculation at least 30 days before departure. The customer may accept the adjustment or cancel the booking within 24 hours of receiving the notice and receive a full refund of all amounts paid to Deep Blue Co., Ltd for the booking, including payment processing fees and booked third-party services, without cancellation charges. No increase takes effect without the customer’s express agreement; silence is not acceptance.

These Terms are governed by Thai law. Disputes are subject to the competent courts of Phuket, Thailand, subject to any mandatory rights or jurisdiction rules that cannot lawfully be excluded.
